Why Idaho’s Legislature “reviews” Administrative Rules

Legislators are currently busy working on reviewing Administrative Rules in Boise this week. During the first few weeks of the Legislative Session, much of our work here in the Capitol involves reviewing rules promulgated by a variety of Idaho State agencies.

This process is one of the important “checks and balances” that protects Idahoans from government overreach and/or law-making by bureaucracies.

Administrative rules are regulations created to carry out more general requirements created by the Legislature in statute. Idaho is one of only three states in the nation with the direct power and responsibility to approve or reject administrative rules implementing laws. This legislative authority over the rule-making process was formally adopted by a vote of the Idaho people in 2016 when Idaho’s Constitution was amended to assure that the Legislature remains the only law-making body in state government.
